It should definitely be punishable by law. The Take It Down Act mostly deals with fake videos and non-consensual intimate content, it doesn’t actually cover cyberbullying. So, a new law will need to be introduced to specifically address online bullying, because the current act just doesn’t cover it.
Laws are meant to protect us, but sometimes they fall short, especially when there’s no law yet for something like cyberbullying. Until then, people have to take control of their own accounts and do what’s best for their safety.
As far as I know, there hasn’t been any law introduced yet that truly tackles cyberbullying head-on, and that’s a problem.
For context, the Take It Down Act, signed into law on May 19, 2025, targets the sharing of non-consensual intimate images, including AI deepfakes and revenge porn. It criminalizes publishing or threatening to publish those images without consent, with penalties up to two years in prison. Platforms are also required to remove reported content within 48 hours and prevent it from coming back.
That’s important, but it doesn’t address bullying itself. Until cyberbullying is treated as its own crime, people will keep falling through the cracks.
